ESIC Scheme 2022

The Employees’ State Insurance Yojana is an integrated measure of Social Insurance embodied in the Employees’ State Insurance Act & it is designed to accomplish the task of protecting ’employees’ as defined in the Employees’ State Insurance Act, 1948 against the impact of incidences of sickness, maternity, disablement & death due to employment injury & to provide medical care to insured persons & their families.

The ESI Yojana applies to factories & other establishment’s viz. Road Transport, Cinemas, Newspaper, Shops, Hotels, Restaurants, & Educational/Medical Institutions wherein 10 or more persons are employed. However, establishments in some states still have a coverage limit of 20.

Employees of the aforesaid categories of factory & establishments, drawing wages up to Rs.15000/- a month, are entitled to social security cover down the ESI Act. ESI Corporation has also decided to Eke the wage ceiling for coverage of employees down the ESI Act from Rs.15000/- to Rs.21000/-.

 

Section 46 of the Act envisages the following six social security advantage:-

Medical advantage: Full medical care is provided to an Insured person & his family members from the day he enters insurable employment. There is no ceiling on expenditure on the treatment of an Insured people or his family member. Medical care is as well provided to retired and permanently disabled insured people & their spouses on payment of a token annual premium of Rs.120/-

Organizational Setup

The Director of the ESI Yojana is the HEAD of the Organization and is in overall charge of the Yojana down the administrative control of the Labour & Employment Organization. He is assisted by 1 Joint Director, 1 Deputy Director, 1 Assistant Director, 1 Accounts Officer, 1 Establishment Officer, 4 Section Officers, & 55 other staff. Besides 1 Central medical Store managed by one Deputy Director, 1 Medical Officer, 1 Store Manager, 1 Store Superintendent, and 11 other staff is as well functioning in the ESI Yojana Directorate.

The ESI Yojana Dispensaries & Hospitals are grouped down 3 zones (Central, Northern, Southern)each headed by a joint Director-Cum-Superintendent. They as well work as Medical Superintendents of the hospitals where they are stationed ESI Hospital, Choudwar, Kansbhal, & J.K.Pur. In addition, there are 2 Superintendents at ESI Hospital, Bhubaneswar & Brajrajnagar.

The Dispensaries are headed by Insurance Medical Officer (IMO) in charge either in Class-II or Junior Class-I rank. Administrative & financial powers have been delegated to the Joint Directors, Superintendents, & Insurance Medical officer(IMO) in Charge of sleek management of the Hospitals/Dispensaries.

 

What Is Employees’ State Insurance Scheme

The primary objective of the Govt. of India to launch the ESI Yojana is to cover workers from certain health-related contingencies such as stable or temporary disablement, sickness, death due to employment injury, or occupational disease, which impacts the earning capacity of the worker or leads to losses of income.

This Yojana enables workers to negate the financial burden due to such unfortunate eventualities. The Yojana as well offers maternity advantages to the beneficiaries. ESI Yojana is a cover for workers which protects them with medical care for the insured & their dependents as well as offers a variety of cash advantages during the loss of wages or disablement.

Also, the Yojana offers a pension known as dependent advantages to the family members of the insured people in case of death or injury due to occupational hazards while at work.

 

When is ESI Registration Required

If a company, organization, business establishment employs 10 or more employees and workers & in the case of Maharashtra & Chandigarh much than 20 employees ESI Yojana registration is required. The company should register itself with the ESIC Yojana. As for workers or employees, they are covered or entitled down ESI Yojana when they earn less than Rs.21000 per month & Rs.25000 in the case of a people with a disability.

The worker contributes 1.75% of their salary while the employer contributes 4.75% towards the ESI Yojana. Those workers whose daily average wage is up to Rs.50 are exempted from contributing to the ESI Yojana fund; however, employers will continue to contribute to these laborers.

 

Documents Necessary For ESI Online Registration

  • The Registration Certificate is acquired down the Shops & Establishment Act or Factories Act.
  • In case of partnership or company there should be a certificate of registration.
  • There should also be articles of association and memorandum of association of the company.
  • There should also be a list of all the employees working in the establishment.
  • Compensation details of all employees.
  • PAN Card information of the Business Entity & of all employees.
  • It is also necessary to have a canceled check of the company's bank account.
  • Register which includes the attendance information of the employees.
  • Employer’s Registration Form should be downloaded online, filled, & uploaded on the ESIC website along with the above-mentioned documents.
